Kathy Ann Sutherland, 61, of Box Elder, Montana, was sentenced to 12 months and 1 day in federal prison on February 14, 2018, for wire fraud after systematically looting more than $111,902.50 from the Rocky Boy Health Clinic’s employee loan program. U.S. District Judge Brian Morris also ordered two years of supervised release, $111,902.50 in restitution, and a $100 special assessment.
Sutherland began as Cash and Grants Manager for the Chippewa Cree Tribe’s Rocky Boy Health Clinic and eventually rose to interim Chief Financial Officer. In that role, she oversaw internal loan disbursements meant to assist staff with short-term financial needs. The rules were clear: employees needed loan committee approval and couldn’t qualify if they owed more than $800. Sutherland ignored both.
Over time, she issued unauthorized loans to herself, bypassing all oversight. The total stolen amounted to $111,902.50—money the clinic, funded by federal tribal health grants, could not afford to lose. Even with payroll deductions, Sutherland’s payback schedule would have stretched beyond age 81, if she’d kept paying. She didn’t.
Ryan G. Weldon, prosecutor in the case, laid it bare in a sentencing memo: ‘Sutherland’s actions are particularly problematic when she knew about other prosecutions, and she was serving as the interim chief financial officer during some of her embezzlement. Her actions were calculated and without regard for the law.’
The Health and Human Services, Office of Inspector General (HHS-OIG), led the investigation, uncovering a paper trail of falsified approvals and unchecked disbursements. Sutherland exploited trust, authority, and bureaucratic blind spots to feed her scheme.
This case is part of a broader crackdown by the U.S. Attorney’s Guardians Project, a federal anti-corruption strike force active since 2011. It’s another scar on a string of public corruption cases draining tribal and federal resources in Montana—where accountability, when it comes, arrives late and hard.
