Arvin Red Bear, Assault, South Dakota 2014

Arvin Red Bear, 52, a resident of Eagle Butte, South Dakota, has been hit with federal charges in connection with an alleged assault that occurred in June 2014.

According to information obtained by Grimy Times, Red Bear was indicted by a federal grand jury on November 13, 2014, on two counts: Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.

The alleged assault is said to have taken place on June 29, 2014. Red Bear, who appeared before U.S. Magistrate Judge Mark A. Moreno on November 20, 2014, has pleaded not guilty to the indictment.

The maximum penalty for conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and a $200 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The investigation into the alleged assault is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Troy R. Morley handling the prosecution.

Red Bear has been released on bond pending trial, with a trial date yet to be set.

The charges against Red Bear are merely accusations, and he is presumed innocent until and unless proven guilty.
