Corrections Officer Sentenced for Excessive Force
In a shocking case of police brutality, Brian J. Phillips, a 32-year-old former corrections officer at the Loudon County Jail, has been sentenced to five months in prison for using excessive force against a detainee. The incident occurred on January 25, 2021, when Phillips, while monitoring a pod of detainees and inmates eating dinner, violently attacked detainee E.H. after he received a second dinner tray, which was not permitted.
According to court documents, Phillips approached E.H., knocked the tray from his hands, and then wrapped his arms around E.H.'s waist and hip-slammed him headfirst into the concrete floor, fracturing E.H.'s skull and rendering him momentarily unconscious. The brutal attack was a clear abuse of power and a blatant disregard for the safety and well-being of the detainee.
Phillips, who is currently residing in Georgia, pleaded guilty to one count of the use of excessive force under color of law, in violation of 18 U.S.C. § 242. The plea agreement, filed with the court, waived an indictment by a Federal Grand Jury. Following his incarceration, Phillips will be on supervised release for a period of two years.
U.S. Attorney Francis M. Hamilton, III, and Special Agent in Charge, Joseph E. Carrico, of the Federal Bureau of Investigation (FBI), announced the sentencing. The case was the result of an investigation conducted by the FBI, with Assistant United States Attorneys William A. Roach, Jr., and Jeremy S. Dykes prosecuting the case.
