On November 16, 2005, a federal indictment was filed against Carlos Burgos in the U.S. District Court for the District of Vermont, charging him with violating the federal firearms laws. Burgos was accused of possessing a firearm with an obliterated serial number.

According to court documents, the investigation into Burgos began on January 10, 2005, after local law enforcement received a tip that he was in possession of a firearm with an altered serial number. Following a search of Burgos' residence, authorities discovered a .45 caliber pistol with its serial number removed.
