Assault Charge Lands Mission Man in Hot Water

In a disturbing turn of events, Charles Black Spotted Horse, 24, of Mission, South Dakota, has been charged with Domestic Assault by an Habitual Offender and Assaulting, Opposing, Resisting, and Impeding a Federal Officer.

According to court records, Black Spotted Horse was indicted on August 16, 2016, and appeared before U.S. Magistrate Judge Mark A. Moreno on August 25, 2016, where he pleaded not guilty to the indictment.

The charges allege that on April 29, 2016, Black Spotted Horse unlawfully assaulted his spouse, who was a victim of domestic violence. Furthermore, the indictment claims that on the same date, Black Spotted Horse forcibly assaulted, resisted, opposed, impeded, intimidated, and interfered with an officer from the Rosebud Sioux Tribe, while that officer was engaged in the performance of their official duties.

The maximum penalty upon conviction is up to 5 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund for each count. Additionally, restitution may also be ordered.

Black Spotted Horse was released on bond pending trial. A trial date has not been set.

The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Kirk W. Albertson is prosecuting the case.

In a statement, U.S. Attorney Randolph J. Seiler emphasized that the charges are merely an accusation and that Black Spotted Horse is presumed innocent until and unless proven guilty.

In related news, the Rosebud Sioux Tribe Law Enforcement Services has issued a statement urging residents to report any instances of domestic violence or assault to the authorities immediately.

The case is a sobering reminder of the severity of domestic violence and the importance of holding perpetrators accountable for their actions.
