Three South Dakotans Sentenced for Possession of a Controlled Substance
A man and woman from South Dakota and a woman from North Dakota have been sentenced for their involvement in a cocaine and methamphetamine possession case.
According to court documents, Clemmy Swimmer, 30, of Timber Lake, South Dakota, Theresa Cadotte, 23, of Ft. Yates, North Dakota, and Francis Dubray, 24, of Wakpala, South Dakota, were sentenced on March 28, 2013 by U.S. Magistrate William D. Gerdes for two counts of Possession of a Controlled Substance.
The investigation, led by the Northern Plains Safe Trails Drug Enforcement Task Force, revealed that the defendants knowingly and intentionally possessed cocaine and methamphetamine, both controlled substances, between December 23, 2011 and December 28, 2011.
Cadotte and Swimmer were sentenced to 3 years of probation on each count to run concurrently, a $1,000 fine on each count, and a $25 special assessment on each count to the Victim Assistance Fund. Dubray was sentenced to time served with 1 year of supervised release, a $1,000 fine on each count, and a $25 special assessment on each count to the Victim Assistance Fund.
The case was prosecuted by Assistant U.S. Attorney Kathryn N. Rich.
The defendants were initially indicted by a federal grand jury on June 12, 2012 and pled guilty to an Information in December.
