Cedar Rapids Man Pleads Guilty to Discharging Shotgun into Apartment Above His Own
Clifford Smith, age 51, from Cedar Rapids, Iowa, pleaded guilty to being a felon and unlawful drug user in possession of a firearm yesterday in federal court in Cedar Rapids. Smith, a resident of Cedar Rapids, Iowa, will face a possible maximum sentence of ten years' imprisonment, a $250,000 fine, $100 in special assessments, and three years of supervised release following any imprisonment.
According to court documents, Smith was convicted in 1992 and 2003 of drug offenses in the Iowa District Court for Linn County. At the time of the incident, Smith was living in a downstairs apartment on Wilson Avenue in Cedar Rapids. On July 4, 2013, Smith discharged a shotgun in his apartment, causing the blast to penetrate the floor of the apartment above Smith’s own apartment. The owner of that apartment contacted the Cedar Rapids Police in response to the incident.
Smith admitted to being a felon and an unlawful user of marijuana as part of a plea agreement. The case is being prosecuted by Assistant United States Attorney C.J. Williams and was investigated by the FBI Safe Streets Task Force and the Cedar Rapids Police. Smith remains in custody of the United States Marshal and will remain in custody pending sentencing.
