Boston Career Criminal Pleads Guilty to Drug and Firearm Charges

BOSTON, MA - A career criminal with a long history of violence has pleaded guilty to drug and firearm charges in federal court. Damian Bynoe, 44, of Roxbury, Massachusetts, was found guilty of being a felon in possession of a firearm and ammunition, as well as possession with intent to distribute heroin and cocaine.

The guilty plea came after Bynoe was arrested on January 19, 2019, when police executed a search warrant at an apartment in Roxbury tied to Bynoe. During the search, officers seized a loaded gun, heroin, and cocaine from the apartment, as well as additional amounts of heroin and cocaine from Bynoe himself.

Bynoe's criminal record includes a 1991 juvenile delinquency adjudication for murder and unlawful possession of a firearm, in which he shot and killed two teenagers on a Roxbury street. He also has convictions for assault with a firearm in 2007, distribution of cocaine in a school zone in 2001, and distribution of cocaine base within 1000 feet of a school in 2009.

On the felon in possession of a firearm charge, Bynoe faces a mandatory minimum sentence of 15 years and up to life in prison, up to five years of supervised release, and a fine of up to $250,000. The charge of possession with intent to distribute heroin and cocaine provides for a sentence of up to 30 years in prison, at least six years of supervised release, and a fine of up to $2 million.

Sentencing is scheduled for April 29, 2020. United States Attorney Andrew Lelling, Kelly D. Brady, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives, Boston Field Division, and Boston Police Commissioner William Gross announced the guilty plea.

Assistant U.S. Attorney Christopher Pohl of Lelling's Narcotics and Money Laundering Unit is prosecuting the case.
