Daniel J. Fillerup, Distribution of Fentanyl Resulting in Death, New York 2016

ALBANY, NEW YORK – A local man has been charged with distributing fentanyl that resulted in another person's death.

Daniel J. Fillerup, 34, of Albany, New York, was charged today with distribution of fentanyl that resulted in another person’s death.

According to the criminal complaint, Fillerup distributed fentanyl to a woman identified as “K.C.” on September 29, 2016. When it became apparent that K.C. was in distress from using the drugs, Fillerup brought her to the Ellis Hospital Emergency Room. Minutes after bringing her to the hospital, Fillerup left, but was located later that day by Schenectady Police. K.C.’s cause of death was cardiac arrhythmia due to fentanyl intoxication.

Fillerup appeared today before United States Magistrate Judge Daniel J. Stewart and was ordered detained pending further proceedings.

The charges in the complaint are merely accusations. The defendant is presumed innocent unless and until proven guilty.

If convicted of the offense of distributing a controlled substance resulting in death, Fillerup faces at least 20 years and up to life in prison. A defendant’s sentence is imposed by a judge based on the particular statute the defendant is charged with violating, the U.S. Sentencing Guidelines and other factors.

This case was investigated by the FBI and the Schenectady Police Department, with assistance from the Saratoga County Sheriff’s Office, and is being prosecuted by Assistant U.S. Attorney Douglas Collyer.
