Rapid City Man Sentenced for Illegal Possession of Firearm
RAPID CITY - A Rapid City man has been sentenced to prison for illegally possessing a firearm. U.S. District Judge Karen E. Schreier handed down the sentence on July 26, 2024, to 26-year-old Darian Libert.
Liber, a previously convicted felon, was prohibited from possessing firearms. However, in July 2023, law enforcement officers found him in possession of a Sturm, Ruger & Company .380 AUTO caliber semi-automatic pistol in Rapid City. Libert fled the scene after being involved in an accident on Deadwood Avenue, but was later apprehended and found with the firearm in his pocket.
Libert was indicted by a federal grand jury in February 2024 for Possession of a Firearm by a Prohibited Person. He pleaded guilty to the charges on May 1, 2024.
As part of the sentence, Libert was ordered to serve one year and nine months in federal prison, followed by three years of supervised release. He was also required to pay a $100 special assessment to the Federal Crime Victims Fund.
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rapid City Police Department. Assistant U.S. Attorney Benjamin Patterson prosecuted the case.
Libert was immediately remanded to the custody of the U.S. Marshals Service.
