David Aaron Freyn, False Statement During Purchase of Firearm, South Dakota 2019
A Pueblo, Colorado, man was sentenced for making a false statement during the purchase of a firearm in Sioux Falls, South Dakota.
On July 15, 2019, U.S. District Judge Karen E. Schreier sentenced David Aaron Freyn, age 40, to 2 years of probation, 40 hours of community service, and a special assessment to the Federal Crime Victims Fund in the amount of $100.
Freyn was convicted of False Statement During Purchase of Firearm. He was indicted by a federal grand jury on May 8, 2018, and pled guilty on April 22, 2019.
The conviction stemmed from an incident on November 6, 2016, when Freyn purchased a firearm at a gun shop in Sioux Falls. He filled out a Bureau of Alcohol, Tobacco, Firearms, and Explosives Form 4473, Firearms Transaction Record, but knowingly made a false and fictitious written statement on that form when he claimed to be the actual buyer of the firearm.
Freyn knew he was purchasing the firearm for another person, a felon who was prohibited from buying or possessing firearms.
This case was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Assistant U.S. Attorney Jeffrey C. Clapper prosecuted the case.
