David Gordon Weaks, Receipt of Child Pornography, California 2019

A former San Diego Unified School District teacher has been sentenced to 70 months in prison for his role in a child pornography case. David Gordon Weaks, 60, was a fifth-grade teacher at Rosa Parks Elementary School until his arrest in April 2018.

Weaks was found to have possessed and distributed child pornography through a peer-to-peer file sharing network. Agents from Homeland Security Investigations discovered the illicit content on devices seized from Weaks' residence during the April 19, 2018, search warrant.

According to court documents, child pornography files were found on a desktop computer, two laptop computers, and a backup hard drive at Weaks' residence. Weaks pleaded guilty to one count of receipt of images of minors engaged in sexually explicit conduct.

Weaks' sentence includes an eight-year term of supervised release, with restrictions on his use of the internet. He is currently in custody, facing the mandatory minimum of 5 years in prison and a maximum of 20 years for the crime.

The case was investigated by Homeland Security Investigations. Weaks is currently being held at a federal facility, awaiting transfer to a federal prison.

Weaks' term of custody will be followed by an eight-year term of supervised release, including restrictions on his use of the internet. Child pornography is a serious crime, and those found guilty face severe penalties.
