Eagle Butte Man Charged with Domestic Assault After Unlawful Strangulation and Suffocation, Federal Prosecutors Say

Dustin Marrowbone, a/k/a Dustin Condon, age 30, has been indicted on federal charges of Domestic Assault by a Habitual Offender and Assault by Strangulation and Suffocation, according to the U.S. Attorney's Office in South Dakota.

According to prosecutors, Dustin Marrowbone was previously convicted on at least two previous occasions of assaulting a spouse or intimate partner.

The indictment alleges that on May 12, May 26, and June 14, 2020, in Dewey County, South Dakota, Marrowbone unlawfully assaulted his intimate partner by strangulation and suffocation.

The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.

Assistant U.S. Attorney Jay Miller is prosecuting the case, which is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services.

Marrowbone was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.

The charges are merely accusations, and Marrowbone is presumed innocent until and unless proven guilty.

According to investigators, Marrowbone's actions were a blatant disregard for the law and the safety of his intimate partner.

The case serves as a reminder of the importance of holding perpetrators accountable for their crimes.
