Elijah Jeremiah Smith, Assault of a Correctional Officer Resulting in Bodily Injury, West Virginia 2019

An inmate at FCI Hazleton has been charged with a violent crime after allegedly assaulting a correctional officer at FCI Gilmer in Gilmer County.

Elijah Jeremiah Smith, 23, was indicted on one count of “Assault of a Correctional Officer Resulting in Bodily Injury” for allegedly attacking a correctional officer in September 2019.

The alleged assault occurred while Smith was being housed at FCI Gilmer, a federal correctional facility in West Virginia.

Smith faces up to 20 years incarceration and a fine of up to $250,000 if convicted. The actual sentence will be determined by the seriousness of the offense and Smith’s prior criminal history, if any.

Assistant U.S. Attorney Brandon S. Flower is prosecuting the case on behalf of the government. The Bureau of Prisons investigated the incident.

An indictment is merely an accusation. Smith is presumed innocent unless and until proven guilty.
