Emily Ann Nelson, Fentanyl Distribution, Iowa 2021
A Dubuque woman has been convicted of distributing fentanyl that led to an overdose. Emily Ann Nelson, 29, from Dubuque, Iowa, pleaded guilty on October 14, 2021, in federal court in Cedar Rapids, Iowa.
Nelson was found guilty of one count of distribution of fentanyl. The evidence presented in a prior hearing showed that Nelson distributed a substance, believed to be heroin, to another person in July 2020.
The person who received the substance overdosed, but was revived by first responders using the opioid antidote, Narcan. Nelson admitted to distributing fentanyl to the person who overdosed during her plea hearing.
Following the overdose incident, a confidential informant working with the Dubuque Drug Task Force contacted Nelson to purchase heroin. However, Nelson stole the money intended for the drugs. Approximately two weeks later, the informant again contacted Nelson, and she obtained the drugs as agreed. However, Nelson used a portion of the drugs before being arrested by officers.
Nelson faces a possible maximum sentence of 20 years' imprisonment, a $1,000,000 fine, and a lifetime of supervised release following any imprisonment. Sentencing will be set after a presentence report is prepared.
The case was investigated by the Dubuque Drug Task Force and is being prosecuted by Assistant United States Attorney Dan Chatham. Nelson remains in custody of the United States Marshal pending sentencing.
