Erasmo Briseno, Conspiracy to Distribute a Controlled Substance, South Dakota 2024

RAPID CITY - A local man has been sentenced for his role in a conspiracy to distribute a controlled substance in Spearfish, South Dakota. Erasmo Briseno, 32, was handed down an 18-month prison sentence, to be followed by three years of supervised release, by U.S. District Judge Karen E. Schreier on March 29, 2024.

Briseno was convicted of Conspiracy to Distribute a Controlled Substance, a charge stemming from his involvement in a scheme to distribute cocaine from Texas to Spearfish. The scheme, which began in September 2020 and continued until his arrest in October 2022, involved Briseno and five other co-conspirators who knowingly conspired and agreed with each other to intentionally distribute the controlled substance.

The cocaine was shipped through the U.S. Postal Service to South Dakota for the purposes of sale and distribution in the state. The Spearfish Police Department and the Unified Narcotics Enforcement Team conducted the investigation of the conspiracy, which ultimately led to Briseno's arrest and conviction.

Assistant U.S. Attorney Brian J. Murphy prosecuted the case, which resulted in Briseno's guilty plea on March 29, 2024. As a result of his conviction, Briseno was ordered to pay a $100 special assessment to the Federal Crime Victims Fund.

Briseno was immediately remanded to the custody of the U.S. Marshals Service following his sentencing. The investigation and prosecution of this case serve as a reminder of the importance of addressing the ongoing issue of controlled substance distribution in our community.
