Nebraska Man Sentenced to 262 Months in Prison for Methamphetamine Distribution

OMAHA, Nebraska – Francisco Herrera, 37, of Sterling, Colorado, was sentenced to 262 months in prison for his role in distributing methamphetamine in Nebraska.

Herrera was sentenced on January 4, 2021, in federal court in Omaha, Nebraska. Senior United States District Judge Joseph F. Bataillon handed down the sentence. Herrera has at least two prior drug convictions, which classified him under the U.S. Sentencing Guidelines as a career offender, enhancing his sentencing guideline range to 262-327 months.

Without the enhancement, Herrera's sentencing range would have been 151-188 months. There is no parole in the federal system, and after his release from prison, he will begin a five-year term of supervised release.

The investigation into Herrera's methamphetamine distribution operation began on May 10, 2019, when local law enforcement executed a search warrant on a residence in Sidney, Nebraska. During the execution of the search warrant, Herrera's vehicle was located in the driveway, and a search warrant was obtained for the vehicle.

Approximately ten pounds of methamphetamine were seized from the vehicle during the search. The case was investigated by the Sidney Police Department.

Herrera was found guilty of possession with intent to distribute 500 grams or more of methamphetamine. His sentencing brings an end to a lengthy investigation into his methamphetamine distribution operation in Nebraska.
