George Scott, Assault With a Dangerous Weapon, South Dakota 2017

Two St. Francis, South Dakota, men have been charged with assault following a federal indictment. George Scott, age 32, and Kyle Swift Hawk, age 24, were indicted on July 11, 2017, on charges of Assault With a Dangerous Weapon and Assault Resulting in Serious Bodily Injury.

The charges stem from an incident on June 12, 2017, in which Scott and Swift Hawk allegedly assaulted an individual with a knife and their shod feet, causing serious bodily injury.

Scott and Swift Hawk appeared before a federal magistrate, with Scott pleading not guilty on July 20, 2017, and Swift Hawk on August 9, 2017.

The maximum penalty upon conviction is up to 10 years in prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.

The investigation into the assault is being conducted by the Rosebud Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Kirk Albertson prosecuting the case.

Scott and Swift Hawk were remanded to the custody of the U.S. Marshals Service pending trial, which has been set for September 19, 2017. The indictment alleges that the assault was committed with the intent to do bodily harm.

The charges are merely accusations, and Scott and Swift Hawk are presumed innocent until and unless proven guilty.
