Buffalo Man Pleads Guilty to Heroin Distribution Conspiracy

BUFFALO, N.Y. – U.S. Attorney William J. Hochul Jr. announced today that Ivan Rosario, 20, of Buffalo, NY, pleaded guilty before U.S. District Court Judge Richard J. Arcara to conspiracy to possess with intent to distribute and to distribute 100 grams or more of heroin.

The charge carries a mandatory minimum sentence of five years in prison, a maximum of 40 years, a fine of $5,000,000 or both.

Assistant U.S. Attorney Edward H. White stated that from 2011 through February 4, 2014, the defendant conspired with others to possess and distribute 100 grams or more of heroin and fentanyl, a Schedule II controlled substance.

As part of the conspiracy, Rosario maintained a residence in Buffalo for the purpose of distributing heroin and fentanyl to his customers. The defendant sold the drugs on a daily basis and received cash paid by customers.

The plea was the culmination of an investigation on the part of Special Agents of the Drug Enforcement Administration, under the direction of James J. Hunt, Special Agent in Charge, New York Field Division.

Sentencing is scheduled for May 13, 2015 at 12:30 p.m. before Judge Arcara.

According to the U.S. Attorney's Office, Ivan Rosario faces a mandatory minimum sentence of five years in prison and a maximum of 40 years. He also faces a fine of up to $5,000,000.

The investigation was conducted by the Drug Enforcement Administration.
