Disability Benefits Fraud Lands Akron Man 30 Months in Prison

An Akron man's scheme to defraud federal and state agencies has come to an end with a 30-month prison sentence. James Van Buskirk, 53, pleaded guilty earlier this year to 11 counts of theft of government funds, wire fraud, and fraudulently securing Social Security benefits.

According to the U.S. Attorney for the Northern District of Ohio, Steven M. Dettelbach, Van Buskirk stole nearly $350,000 from disability programs by claiming he was unable to work while secretly working as a home-repair contractor. The scheme lasted from approximately November 2002 through April 2014.

The defendant falsely applied for and received $269,932 from the Ohio Bureau of Worker’s Compensation (OBWC) and $75,823 in Social Security benefits. Van Buskirk concealed his self-employment, knowing it would affect his right to Social Security disability benefits.

Assistant United States Attorney Matthew J. Cronin prosecuted the case, following an investigation by the SSA Office of Inspector General and the OBWC. Dettelbach emphasized that these programs are meant to help those who are truly disabled and cannot work.

Van Buskirk's actions demonstrate a clear abuse of these programs for personal enrichment. The U.S. Attorney's Office will continue to prosecute those who take advantage of disability benefits for selfish reasons.

James Van Buskirk, a 53-year-old Akron man, was sentenced to 30 months in prison for disability benefits fraud. The case highlights the importance of monitoring and preventing such schemes to protect the integrity of these vital programs.

Background information on the case indicates that Van Buskirk executed his scheme from 2002 to 2014, with the assistance of various government agencies. This investigation showcases the collaborative efforts of law enforcement and regulatory bodies to combat disability benefits fraud.
