Jesse Phillip Clairmont, Jr. and Tera Jo Larvie, Burglary and Larceny, South Dakota 2020
A Rosebud man and woman have been charged with second-degree burglary and larceny in a federal indictment.
Jesse Phillip Clairmont, Jr., age 42, and Tera Jo Larvie, age 27, are accused of unlawfully entering a home in Todd County, South Dakota, on January 23, 2020, and stealing personal property valued at over $1,000.
The charges against Clairmont and Larvie are mere accusations and Larvie is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Michael J. Elmore prosecuting the case.
Clairmont pleaded not guilty to the indictment on April 13, 2020, but later changed his plea to guilty on August 12, 2020. A sentencing date has been set for November 2, 2020.
Larvie appeared before U.S. Magistrate Judge Mark A. Moreno on October 7, 2020, and also pleaded not guilty to the indictment. She was released on bond pending trial, and a trial date has not been set.
The maximum penalty upon conviction is up to 15 years in federal prison and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
