Justin Miles Ness, Felon in Possession of Firearm & Ammunition, Oklahoma 2022
A federal jury has found Porum resident Justin Miles Ness, 40, guilty of Felon in Possession of Firearm & Ammunition.
The verdict was delivered on March 2, 2022, following a two-day trial that began on March 1, 2022.
Ness faces up to ten years of imprisonment for the crime. The guilty verdict was the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Federal Bureau of Investigation.
On September 8, 2021, federal agents served a federal search warrant on Ness's residence in Porum, Oklahoma, where they seized a firearm and over 500 rounds of ammunition. The evidence also included photographs, video/audio and text messages from Ness's Facebook account that showed the defendant discussing the acquisition of firearms.
The Honorable John F. Heil, III, U.S. District Judge in the United States District Court for the Eastern District of Oklahoma in Muskogee, presided over the trial and ordered the completion of a presentence report. Sentencing will be scheduled following completion of the report. Ness was remanded to the custody of the United States Marshal pending the imposition of sentencing.
