Kim Davis, Extortion, New Jersey 2007
East Orange, N.J. construction official Kim Davis, 46, of New York and formerly of Newark, was sentenced to 18 months in prison for extortion. Davis accepted a $5,000 corrupt payment in exchange for official action, specifically to expedite the process of obtaining the requisite permits and certificates from the building department to build a new residence.
According to documents filed in this case and statements in court, Davis and an inspector in the code and enforcement division of the property maintenance department, referred to as 'Coconspirator One' or Billie Muhammad, conspired in 2007 to advise an East Orange property owner that Davis would provide the necessary permits and certificates in exchange for a $5,000 cash payment.
On September 7, 2007, Davis met with the property owner and accepted the $5,000 cash payment in exchange for his official assistance. This incident led to Davis's indictment and subsequent guilty plea before U.S. District Judge William H. Walls.
As part of his guilty plea, Davis agreed to Count Two of the indictment, charging him with extortion under color of official right. Judge Walls imposed the sentence today in Newark federal court.
In addition to the 18-month prison term, Judge Walls sentenced Davis to 1 year of supervised release and fined him $1,000.
The investigation was led by special agents of the FBI, under the direction of Special Agent in Charge Aaron T. Ford. The government is represented by Assistant U.S. Attorneys Vikas Khanna and Barbara Llanes of the U.S. Attorney's Office Special Prosecutions Division in Newark.
Defense counsel for Davis was Patrick McMahon Esq., Assistant Federal Public Defender, Newark.
