Rapid City Man Sentenced for Firearm Possession

A 25-year-old Rapid City man has been sentenced to 46 months in federal prison for possessing a firearm as a convicted felon.

Kyle Tobacco, 25, was convicted of Possession of a Firearm by a Prohibited Person and was sentenced on July 3, 2019 by Chief Judge Jeffrey L. Viken, U.S. District Court.

The charge relates to Tobacco's possession of a .45 caliber semi-automatic pistol in Rapid City in September 2018. Tobacco, a previously convicted felon, is prohibited from possessing firearms.

Tobacco was also ordered to pay a $100 special assessment to the Federal Crime Victims Fund and will serve 3 years of supervised release after his prison term.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rapid City Police Department. Assistant U.S. Attorney Ben Patterson prosecuted the case.

Tobacco was immediately turned over to the custody of the U.S. Marshals Service.

This case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and making neighborhoods safer for everyone. PSN brings together all levels of law enforcement and the communities they serve to develop effective, locally-based strategies to reduce violent crime.
