Marcin Stanislaw Garbacz, Child Exploitation, South Dakota 2020

Convicted embezzler Marcin Stanislaw Garbacz, 41, of Rapid City, South Dakota, is facing new federal charges for his alleged involvement in child exploitation and possession of child pornography.

According to United States Attorney Ron Parsons, Garbacz was previously convicted in March 2020 on 65 counts of wire fraud, money laundering, transfer of stolen money, and filing false tax returns. However, this latest development marks a new and serious charge against the convicted felon.

Garbacz was charged on February 19, 2020, in a sealed indictment with Engaging in Illicit Sexual Conduct in a Foreign Place and Possession of Child Pornography. The maximum federal prison time upon conviction for Engaging in Illicit Sexual Conduct in a Foreign Place is 30 years, and the maximum federal prison time upon conviction of Possession of Child Pornography is 10 years.

Additionally, both charges include a penalty of a potential $250,000 fine, a mandatory minimum of 5 years up to lifetime supervised release, and a $100 assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The charges stem from Garbacz's alleged actions while traveling in Poland, where he video recorded an unclothed minor. The investigation also revealed that Garbacz possessed child pornography on an electronic device.

Garbacz pleaded not guilty to the new charges on November 24, 2020, before U.S. Magistrate Judge Daneta Wollmann. The convicted felon was sentenced on November 23, 2020, to 7 years and 9 months in custody on the previous charges and was subsequently detained pending trial for the new charges.

The investigation is being conducted by the Federal Bureau of Investigation, with Assistant U.S. Attorney Benjamin Patterson prosecuting the case.
