Rochester man's second conviction for child pornography lands him 10-year minimum prison sentence.

Marcobrien S. Volcy, 28, of Rochester, NY, pleaded guilty in federal court to possession of child pornography, a crime that carries a mandatory minimum penalty of 10 years in prison, a maximum of 20 years, and a fine of $250,000. This conviction is the result of an ongoing investigation into Volcy's possession of child pornography despite being on probation following a prior conviction.

According to Assistant U.S. Attorney Katelyn M. Hartford, in August 2023, Volcy pleaded guilty in Monroe County Court to Possessing a Sexual Performance by a Child Less Than 16 Years of Age and was sentenced to one to three years in prison. However, this did not deter Volcy from committing the same crime again.

On January 19, 2024, while on New York State probation for his 2023 conviction, Volcy possessed a cell phone that contained images and videos of child pornography. In total, Volcy possessed more than 650 images and videos of child pornography, some of which depicted prepubescent children. The images and videos were discovered during a search of Volcy's property as part of his probation requirements.

The investigation into Volcy's child pornography possession is being led by the Federal Bureau of Investigation, under the direction of Acting Special Agent-in-Charge Mark Grimm. Volcy's guilty plea is a significant blow to the community and serves as a reminder that child pornography is a serious crime that will be prosecuted to the fullest extent of the law.

Marcobrien S. Volcy's sentencing is scheduled for January 14, 2026, before Chief U.S. District Judge Elizabeth A. Wolford. Volcy will face a mandatory minimum sentence of 10 years in prison, with a maximum of 20 years and a fine of $250,000.
