Mark Antoine, Assault, South Dakota 2013
In a shocking turn of events, Mark Antoine, a 22-year-old resident of Mission, South Dakota, has been charged with two federal crimes. According to a recent indictment, Antoine has been accused of Assault with a Dangerous Weapon and Assaulting, Resisting, Opposing, and Impeding a Federal Officer.
The indictment, which was handed down on December 10, 2013, alleges that Antoine committed the crimes on October 29, 2013, at a family member's house on the Rosebud Sioux Indian Reservation. Antoine allegedly assaulted a family member and later resisted law enforcement officers who were summoned to the scene.
Antoine appeared before U.S. Magistrate Judge Mark A. Moreno on December 18, 2013, and pleaded not guilty to the indictment.
The maximum penalty for conviction is up to 20 years in custody and/or a $250,000 fine, three years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation into Antoine's crimes is being conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Tim Maher is prosecuting the case.
Antoine has been remanded to the custody of the U.S. Marshals Service pending trial. A trial date has been set for February 11, 2014.
The charge against Antoine is merely an accusation, and he is presumed innocent until and unless proven guilty.
