Rapid City Man Charged with Unlawful Possession of Firearm

A Rapid City man has been charged with unlawful possession of a firearm after authorities discovered a Hi-Point 9mm semi-automatic pistol in his possession. Marvin Brings Plenty, 30, was previously convicted of a felony and is prohibited from possessing firearms.

The charge was announced by United States Attorney Ron Parsons on September 17, 2020. Brings Plenty appeared before U.S. Magistrate Judge Daneta Wollmann on September 23, 2020, and pleaded not guilty to the charge. The maximum penalty upon conviction is 10 years in federal prison and/or a $250,000 fine, 3 years’ supervised release, and a $100 assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The charge relates to Brings Plenty possessing the firearm in May 2020 in Rapid City. The charge is merely an accusation and Brings Plenty is presumed innocent until and unless proven guilty.

This case is part of Project Safe Neighborhoods (PSN), a program aiming to reduce violent crime and make neighborhoods safer. The PSN program brings together all levels of law enforcement and the communities they serve to develop effective, locally-based strategies to reduce violent crime.

The investigation is being conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rapid City Police Department. Assistant U.S. Attorney Benjamin Patterson is prosecuting the case. Brings Plenty was detained pending trial. A trial date has not been set.

Brings Plenty, a 30-year-old Rapid City man, was charged with Possession of a Firearm by a Prohibited Person. The charge was filed on September 17, 2020, and is pending in federal district court. The maximum penalty upon conviction is 10 years in federal prison and/or a $250,000 fine, 3 years’ supervised release, and a $100 assessment to the Federal Crime Victims Fund.

The case is also part of Project Guardian, the Department of Justice’s signature initiative to reduce gun violence and enforce federal firearms laws. The investigation is ongoing, and further information will be released as it becomes available.
