Martinsburg Man Pleads Guilty to Possession of an Unregistered Firearm

MARTINSBURG, WEST VIRGINIA - Matthew Dean Smith, a 39-year-old resident of Great Cacapon, West Virginia, has admitted to a firearms charge, announced United States Attorney Bill Powell.

According to the plea agreement, Smith possessed an unregistered silencer in October 2017 in Berkeley County. The crime is punishable by up to 10 years incarceration and a fine of up to $250,000.

Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Assistant U.S. Attorney Lara K. Omps-Botteicher is prosecuting the case on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives and the West Virginia State Police investigated the crime.

U.S. Magistrate Judge Robert W. Trumble presided over the case. Smith's sentencing is pending.

This case is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the West Virginia State Police.

The case was prosecuted by Assistant U.S. Attorney Lara K. Omps-Botteicher.

Matthew Dean Smith has been charged with one count of Possession of an Unregistered Firearm, punishable by up to 10 years in prison and a fine of up to $250,000.

Smith's crime took place in Berkeley County in October 2017.
