San Jose Man Sentenced to 72 Months in Prison for Gun Charge
A San Jose man has been sentenced to 72 months in prison for being a felon in possession of a firearm, announced U.S. Attorney David L. Anderson and Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Special Agent in Charge Rayfield Roundtree.
Michael Anthony Lamb, 28, of San Jose, pleaded guilty to the charge on July 18, 2019. The sentence was handed down by the Honorable Lucy H. Koh, U.S. District Judge.
Lamb was found to be carrying a loaded 9mm Kel-Tec PF-9 pistol with seven full-metal jacket 9mm rounds in the magazine, as well as approximately four grams of cocaine and a jar containing approximately 53 grams of marijuana, while sitting on a planter box on a light rail platform in San Jose.
Lamb ran away from law enforcement officers who were approaching him, throwing the loaded gun into nearby bushes and his backpack aside. He was quickly arrested and the gun and backpack were recovered.
Lamb has been in custody since March 11, 2019.
In addition to the prison term, Judge Koh ordered Lamb to serve a three-year period of supervised release and to pay a $100 special assessment.
The prosecution is the result of an investigation conducted by the ATF and the Santa Clara County Sheriff’s Office.
Lamb was charged by information with one count of being a felon in possession of a firearm and ammunition, in violation of 18 U.S.C. § 922(g)(1).
