Michael G. Malvasi, Unregistered Machine Gun and Ammunition Possession, Ohio 2017
Canfield, Ohio, resident Michael G. Malvasi, 55, has been charged with serious firearms violations. According to the indictment, Malvasi possessed an Interdynamic 9 mm machinegun that was not registered to him in the National Firearms Registration and Transfer Record on August 2, 2017.
Malvasi's indictment includes two counts: possessing a firearm not registered to him in the national firearms registration and transfer record and being a felon in possession of a firearm and ammunition. His 2011 conviction for tax evasion prohibits him from having the firearm and ammunition.
The investigation into Malvasi's activities was conducted by the Canfield Police Department and the Bureau of Alcohol, Tobacco and Firearms. Assistant U.S. Attorney David M. Toepfer is leading the prosecution.
As a felon, Malvasi is barred from possessing firearms and ammunition. His unregistered machine gun and ammunition possession are serious offenses that could result in severe penalties.
Malvasi's case is currently under indictment, and he has not yet been convicted. If convicted, the court will determine his sentence based on factors such as his prior criminal record, his role in the offense, and the characteristics of the violations. In most cases, the sentence will be less than the statutory maximum.
An indictment is not evidence of guilt and does not necessarily indicate that the defendant will be found guilty. The government must prove Malvasi's guilt beyond a reasonable doubt in a fair trial. The court will ultimately decide his fate based on the evidence presented.
