Nelson Leonel Yocute Samayoa, Illegal Re-entry & Failing to Register as a Sex Offender, Rhode Island 2025

A Guatemalan national, Nelson Leonel Yocute Samayoa, 34, a/k/a Marvin Gomez, has been sentenced for reentering the United States illegally and failing to register as a sex offender in Rhode Island.

According to court records, in 2014, Yocute was convicted of second-degree sexual assault and subsequently deported in May of that year. However, he returned to the US and lived and worked in Newport for approximately nine years without registering as a sex offender, as mandated by his 2014 sentence.

Yocute was detained in federal custody on June 23, 2025 and was sentenced to time served and five years of supervised release by U.S. District Court Judge Mary S. McElroy. He remains in federal custody while awaiting deportation proceedings.

The case was investigated by the Newport Police Department, with the assistance of Homeland Security Investigations and the United States Marshals Service.

This case is part of Operation Take Back America, a nationwide initiative that aims to repel the invasion of illegal immigration, eliminate cartels and transnational criminal organizations, and protect communities from violent crime.

Yocute's crimes include reentering the United States illegally and failing to register as a sex offender. He was prosecuted by Assistant United States Attorney Denise M. Barton.

The matter also involved the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN). This case is a part of the efforts to protect the community from perpetrators of violent crime.
