Birmingham Man Sentenced for Ammunition Possession
A federal judge in Birmingham, Alabama, has sentenced a local man to 39 months in prison for being a felon in possession of ammunition.
Nigel Earl Hartley, 43, of Vincent, Alabama, was sentenced on January 2023 by U.S. District Court Judge Madeline Haikala. Hartley pleaded guilty to the charge in January 2023.
The case began on October 13, 2020, when deputies from the Shelby County Sheriff’s Office went to Hartley’s residence in Vincent, Alabama, to arrest him on two active Shelby County arrest warrants. During a search of Hartley’s person incident to the arrest, deputies located six rounds of ammunition in his pocket.
The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) investigated the case, along with the Shelby County Sheriff’s Office. Assistant U.S. Attorney Darius Greene prosecuted the case.
The sentencing of Hartley is a reminder that felons are prohibited from possessing ammunition due to their prior felony convictions. Hartley has multiple prior felony convictions, making him ineligible to possess ammunition.
