Patrick Luke Black Spotted Horse, Assault and Sex Offender Registration, South Dakota 2020
A 31-year-old Rapid City man has been indicted for assault and failure to register as a sex offender. According to the indictment, Patrick Luke Black Spotted Horse assaulted an individual with a sharp-edged instrument on June 14, 2020, in Mellette County, South Dakota. The assault resulted in serious bodily injury.
The indictment also alleges that Black Spotted Horse committed the assault while having failed to register as a sex offender. He was convicted of Sexual Abuse of a Minor in March 2010 and is required to register as a sex offender as a result.
Between May 1, 2020, and June 14, 2020, and again between June 19, 2020, and August 11, 2020, Black Spotted Horse failed to properly register as a sex offender and update his registration, as alleged in the indictment.
The maximum penalty upon conviction is up to 30 years in federal prison and/or a $250,000 fine, 5 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
Black Spotted Horse appeared before U.S. Magistrate Judge Mark A. Moreno on September 23, 2020, and pled not guilty to the Indictment. He was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services and the U.S. Marshals Service. Assistant U.S. Attorney Kirk Albertson is prosecuting the case.
