McLaughlin Man Sentenced for Sexual Abuse of a Minor

A McLaughlin, South Dakota man has been sentenced for the sexual abuse of a 14-year-old girl who was unable to consent to the act. Robert Arnold Stand, 25, was sentenced to 108 months in custody by U.S. District Court Judge Charles B. Kornmann on June 9, 2014.

Stand was convicted of Sexual Abuse of a Person Incapable of Consent, a federal crime. He was indicted by a federal grand jury on November 14, 2013, and pled guilty on January 28, 2014.

The crime occurred on October 5, 2013, at Stand's residence where he was drinking alcohol with friends and the minor victim. The victim consumed a significant amount of alcohol, leading her to drift in and out of consciousness.

During her state of unconsciousness, the victim was brought into the bathroom by Stand, who removed her pants and sexually abused her. At the time of the abuse, Stand knew the victim was intoxicated and unable to consent to the act. He was 10 years older than the victim.

Stand was immediately turned over to the custody of the U.S. Marshals Service after the sentencing. He was also ordered to pay $100 in restitution and a $100 special assessment to the Federal Crime Victims Fund.

The case was investigated by the Bureau of Indian Affairs, Standing Rock Law Enforcement Agency, and prosecuted by Assistant U.S. Attorney Troy R. Morley.
