Robert Chavarillo, Abusive Sexual Contact, New Mexico 2022

A 43-year-old man from San Felipe Pueblo has been sentenced to 190 days of incarceration for engaging in abusive sexual contact with a heavily intoxicated woman.

Robert Chavarillo, an enrolled member of the San Felipe Pueblo, pleaded guilty on December 12, 2022 to abusive sexual contact in Indian Country.

According to the plea agreement, Chavarillo engaged in sexual conduct with the victim, identified as Jane Doe, while she was heavily intoxicated and sleeping. Chavarillo knew that he did not have permission to engage in sexual conduct with Doe at the time.

The incidents took place within San Felipe Pueblo, and Chavarillo will be subject to 5 years of supervised release upon completion of his sentence.

As a result of his conviction, Chavarillo will also be required to register as a sex offender.

The Bureau of Indian Affairs investigated this case, with Assistant United States Attorney Nicholas J. Marshall and Caitlin Dillon prosecuting the case.

Chavarillo's sentence is a reminder that abusive sexual contact is a serious crime that can have devastating consequences for victims.
