Saul McDuffie, Possession of a Loaded Handgun, New York 2019

Saul McDuffie, a 34-year-old Albany resident, has been sentenced to 33 months in prison for unlawful possession of a firearm by a felon.

The sentence was handed down by Chief U.S. District Judge Glenn T. Suddaby on an unknown date in 2023, following McDuffie's guilty plea to the charge.

According to the investigation, McDuffie was in possession of a loaded .380 caliber handgun on North Swan Street in Albany on October 28, 2019. When he saw a marked Albany Police Department (APD) police cruiser pass, he placed the handgun on the tire of a parked car, which was observed by an APD officer responding to a complaint of drug dealing in the area.

McDuffie had prior felony convictions for drug offenses and burglary when he possessed the loaded handgun.

Chief Eric Hawkins of the APD and Kevin Kelly, Special Agent in Charge of the Buffalo Field Office of Homeland Security Investigations (HSI), praised the collaborative efforts of their agencies in bringing the case to justice.

In addition to the prison sentence, McDuffie was also ordered to serve a 3-year term of post-release supervision.

This case was investigated by the APD and HSI, and prosecuted by Assistant U.S. Attorneys Cyrus P.W. Rieck and Rachel Williams.

McDuffie's prior felony convictions make him a convicted felon, and as such, he is not permitted to possess a firearm under federal law.
