Thomas Yu, Conspiracy, California 2023
OAKLAND, California – In a shocking turn of events, Thomas Yu, a 51-year-old former Senior Vice President of United Commercial Bank (UCB), pleaded guilty to conspiracy to commit false bank entries, reports, and transactions in a federal court in San Francisco.
According to the plea agreement, Yu prepared false and misleading quarterly loan loss allowance reports in the third and fourth quarters of 2008, which enabled the bank to artificially inflate its reported earnings to the public. The bank's failure resulted in estimated losses of approximately $1.1 billion, with the Troubled Asset Relief Program (TARP) providing approximately $297 million in federal funds, which have not been repaid.
Yu's conviction is the result of a lengthy investigation by the FDIC, Office of the Inspector General; the Special Inspector General of the Troubled Asset Relief Program; the Board of Governors of the Federal Reserve System and the Consumer Financial Protection Bureau, Office of the Inspector General; and the Federal Bureau of Investigation.
The maximum statutory penalty for a conviction for conspiracy in violation of 18 U.S.C. § 371 is five years in prison and a fine of $250,000, plus restitution. However, any sentence will be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.
Yu is currently released on a $500,000 appearance bond secured by real property. His sentencing hearing has not been scheduled.
The prosecution is led by Assistant U.S. Attorneys Adam A. Reeves and Robert David Rees, with the assistance of Denise Oki, Phillip Villanueva, and Bridget Kilkenny.
The case highlights the importance of corporate accountability and the need for transparency in financial reporting. As the investigation continues, it remains to be seen what other consequences will follow for Thomas Yu and United Commercial Bank.
