FARGO - North Dakota's Guardianship Scandal Deepens

FARGO, North Dakota - In a shocking turn of events, a North Dakota couple, Tim Koropatnicki, 56, and Delyte Koropatnicki, 55, were sentenced for their role in a brazen USDA scam. The duo, who ran DKK Guardianship Service, was found guilty of misusing Supplemental Nutritional Assistance Program (SNAP) benefits intended for their clients.

According to court documents, Tim Koropatnicki changed the personal pin identification number on a client's SNAP card, allowing him and Delyte Koropatnicki to use the Electronic Benefit Transfer (EBT) card for personal purchases. The scheme, which ran from March 2013 through May 2013, resulted in a staggering loss of $6,639.19 to the USDA.

The couple's scheme was uncovered by the United States Department of Agriculture, Office of Inspector General, which led the investigation. Assistant U. S. Attorney Janice Morley prosecuted the case, bringing the perpetrators to justice.

On April 17, 2015, Tim Koropatnicki pleaded guilty to a felony charge of Unauthorized Use of Benefits, while Delyte Koropatnicki pleaded guilty to a misdemeanor offense of Conversion of Public Money, Property, or Records. U. S. District Judge Ralph R. Erickson handed down a severe sentence: 18 months of supervised probation, 100 hours of community service, and restitution of $6,639.19 to the USDA.

The court also imposed special assessments of $100 on Tim Koropatnicki and $25 on Delyte Koropatnicki to be paid to the Crime Victims' Fund. A unique condition of their probation prohibits them from serving in any capacity over financial or personal affairs of any person, with the exception of Delyte Koropatnicki, who is allowed to continue as guardian for individuals she has cared for more than 7 years.
