Toohey admitted to receiving $202,000 from the sale of the golf course property, which he failed to report on his 2006 tax return, resulting in a tax conviction. In addition to the prison sentence, Toohey was ordered to pay restitution in the amount of $540,000 to the Seneca Nation of Indians and $62,821 to the Internal Revenue Service.

The investigation into Toohey's crimes was conducted by the Federal Bureau of Investigation and the Internal Revenue Service, Criminal Investigation Division.
