Tomas Rosario, Attempting to Receive Child Pornography, New York 2024

Rochester, NY - In a disturbing case of child exploitation, Tomas Rosario, a 75-year-old former school bus driver, has pleaded guilty to attempting to receive child pornography, a federal offense that carries a minimum penalty of five years in prison, a maximum of 20 years, and a $250,000 fine.

According to court records, on March 11, 2022, Rosario engaged in a series of explicit conversations with a 13-year-old girl while transporting her to and from school. The conversations, which were captured on the bus's surveillance system, included discussions about the girl's sexual conduct and even requests for explicit photos.

Assistant U.S. Attorney Kyle P. Rossi stated that Rosario's actions were a clear abuse of trust and authority, particularly given his position as a school bus driver. 'Rosario's behavior was deplorable and a betrayal of the trust placed in him as a public servant,' Rossi said.

The investigation into Rosario's actions was conducted by the Rochester Police Department, under the direction of Police Chief David Smith, and the Federal Bureau of Investigation, Child Exploitation Human Trafficking Task Force, under the direction of Agent-in-Charge Matthew Miraglia.

Rosario's plea is a culmination of the investigation, which revealed a pattern of exploitation and abuse. Sentencing is scheduled for September 12, 2024, before U.S. District Judge Frank P. Geraci.
