Verla Ann Still Smoking, Involuntary Manslaughter, Montana 2013
A 41-year-old resident of Browning, Montana, has been sentenced to 30 months in prison for her role in the death of a woman who overdosed on prescription medication.
Verla Ann Still Smoking, 41, was sentenced in U.S. District Court in Great Falls on January 7, 2013, to 30 months in prison, followed by two years of supervised release. She was also ordered to pay a $200 special assessment.
The sentence was handed down after Still Smoking pleaded guilty to involuntary manslaughter and making false statements to law enforcement.
According to the U.S. Attorney's Office, Still Smoking provided prescription medication to the victim, who died on March 19, 2011, after overdosing on oxycodone. Still Smoking initially told investigators that she had not filled her prescriptions on the day of the victim's death, but it was later discovered that she had picked up the medication at a Kalispell pharmacy the day before.
Another witness testified that Still Smoking had given the victim the prescription medication for consumption.
The investigation was conducted by the Federal Bureau of Investigation.
Because there is no parole in the federal system, Still Smoking will likely serve all of the time imposed by the court. However, she has the opportunity to earn a sentence reduction for 'good behavior,' which will not exceed 15% of the overall sentence.
