Woo Jin Yang, Bid-Rigging, California 2009

Published April 30, 2012

A senior sales manager at Hitachi-LG Data Storage Inc. has agreed to plead guilty to participating in a bid-rigging conspiracy involving optical disk drives.

Woo Jin Yang, also known as Eugene Yang, conspired with others to suppress and eliminate competition by rigging bids for optical disk drives sold to Hewlett-Packard Co. between August 2006 and June 2009.

The plea agreement, subject to court approval, calls for Yang to serve six months in a U.S. prison, pay a $25,000 criminal fine, and cooperate with the ongoing investigation.

Hitachi-LG Data Storage Inc. is a joint venture between Hitachi Ltd. and LG Electronics Inc.

Yang is charged with violating the Sherman Act, which carries a maximum fine of $1 million and up to 10 years in prison.

The Antitrust Division, in a statement, said Yang's guilty plea demonstrates its commitment to prosecuting and deterring conduct that harms American businesses and consumers.

The investigation is ongoing, and the division will continue to pursue those who participated in these bid-rigging and price-fixing conspiracies.
