New York Attorney General Letitia James has scored a victory against the Trump administration in a landmark court battle over the suppression of transgender and nonbinary health information in sexual education programs.
In a statement released today, James emphasized that ‘politics has no place’ in youth health education, lambasting the illegal attempt by the previous administration to censor vital information. The Attorney General’s decisive action ensures that young people receive the accurate health data needed to prevent teen pregnancy and sexually transmitted infections.
James led a coalition of 16 attorneys general against the Department of Health and Human Services (HHS), which had attempted to cut off tens of millions in funding from critical sexual education grant programs unless states agreed to remove transgender and nonbinary content from their curricula. The HHS directive was deemed discriminatory and illegal by the United States District Court for the District of Oregon, which issued a preliminary injunction against its enforcement.
The lawsuit filed in September aimed to protect the integrity of the Personal Responsibility Education Program (PREP) and Title V Sexual Risk Avoidance Education (SRAE). The court’s decision effectively bars the administration from imposing its discriminatory conditions and withholding funds.
Joining James in the legal fight were attorneys general from Colorado, Connecticut, Delaware, Hawaii, Illinois, Massachusetts, Maryland, Maine, Michigan, New Jersey, Oregon, Rhode Island, Washington, Wisconsin, and the District of Columbia. The collective action sends a strong message against attempts to suppress accurate health information.
Attorney General James concluded by reiterating her commitment to ensuring that young people have access to the accurate health information they need, underscoring the importance of comprehensive sex education in safeguarding their well-being.
