Attorney General James labeled the order as ‘an authoritarian power grab,’ emphasizing that ‘with this Order, this President is prioritizing his own quest for unchecked power above the rights and will of the public.’ The lawsuit aims to preserve democracy by ensuring fair and just elections.
The coalition argues that the executive order could disenfranchise voters and place excessive burdens on states. Specific concerns include the prohibition of counting mail-in ballots received after Election Day, despite being postmarked on time, and the imposition of a proof of citizenship requirement on federal voter registration forms—a move not authorized by the Constitution or Congress.
The lawsuit asserts that the president’s actions are illegal under existing laws such as the National Voting Rights Act (NVRA) and that the proposed changes to voter registration would undermine the Election Assistance Commission’s independence. The attorneys general argue that states, not the federal government, administer elections in the U.S., and any burdens placed on them by presidential orders are unauthorized.
The coalition aims to protect the rights of eligible voters from unnecessary obstacles and maintain the integrity of the electoral process.
