New York Attorney General Letitia James has filed a lawsuit against the Trump administration for its alleged illegal blocking of billions in congressionally approved electric vehicle (EV) infrastructure funding.
The lawsuit, joined by 15 other state attorneys general and the governor of Pennsylvania, charges that the U.S. Department of Transportation (DOT) and the Federal Highway Administration (FHWA) have unconstitutionally frozen funds designated for EV charging projects under the Bipartisan Infrastructure Investment and Jobs Act.
James asserts that the administration’s actions represent a brazen attempt to circumvent Congress by arbitrarily withholding funds, threatening democracy’s checks and balances. The coalition demands the court intervene, arguing the funding freeze obstructs vital infrastructure investments and hinders state and local projects aimed at reducing pollution and creating jobs.
In New York alone, a nearly $15 million grant intended to install 1,000 EV charging stations across public locations is on hold due to the administration’s refusal to release funds. The coalition maintains that this illegal impoundment violates both the Constitution and the Administrative Procedure Act.
Joining James in the lawsuit are attorneys general from Arizona, California, Colorado, Delaware, Illinois, Maryland, Massachusetts, Michigan, New Jersey, Oregon, Rhode Island, Vermont, Washington, Wisconsin, and the District of Columbia, as well as Pennsylvania’s governor.
The coalition seeks a court declaration that the funding freeze is unlawful and demands that DOT and FHWA immediately comply with their legal obligations to obligate and distribute the funds.
