GRIMY TIMES – A Rapid City, South Dakota native has been hit with severe federal charges after being caught with firearms. Matthew Dubray, 35, is facing two counts of Possession of a Firearm by a Prohibited Person.
The United States Attorney Randolph J. Seiler made the announcement, noting that Dubray was charged on February 22, 2017. The defendant appeared before U.S. Magistrate Judge Daneta Wollmann on March 10, 2017, where he pleaded not guilty to the charges.
Should Dubray be convicted, he could face a maximum penalty of 10 years in federal prison and/or a $250,000 fine. Additionally, he may serve 3 years of supervised release and make a payment of $100 to the Federal Crime Victims Fund. Restitution could also be ordered.
The charges stem from Dubray’s possession of two HiPoint 9mm pistols while prohibited from owning firearms. The case is a stark reminder of the dangers posed by prohibited persons in possession of deadly weapons.
Investigations into this matter are being led by the Bureau of Alcohol, Tobacco, Firearms & Explosives, and the Rapid City Police Department. Assistant U.S. Attorney Ben Patterson is handling the prosecution.
Dubray has been released pending trial, with no trial date set as of yet.
