McLAUGHLIN, SD — The grim halls of justice were once again echoing with the weighty charge of sexual abuse as Frankie Marshall, a 27-year-old from McLaughlin, South Dakota, faced federal charges for what law enforcement deemed an act of brazen aggression. United States Attorney Randolph J. Seiler announced that a federal grand jury had indicted Marshall for Aggravated Sexual Abuse.
The dark details of the crime were laid bare in court documents: on March 29, 2017, Marshall is accused of using force to cause and attempt to cause a female victim to engage in a sexual act. The charge, severe in nature, carries with it the specter of a life sentence should Marshall be convicted.
In an arraignment that would shape his legal destiny, Marshall stood before U.S. Magistrate Judge William D. Gerdes on April 13, 2017, where he flatly pled not guilty to the charges. The courtroom was silent as the future of this defendant hung in the balance.
The penalties for such a crime are steep. If found guilty, Marshall could face life in custody and/or a $250,000 fine, along with a lifetime of supervised release. His wallet would also be lighter by $100, to be contributed to the Federal Crime Victims Fund, and an additional $5,000 to the domestic trafficking victims’ fund. Should the sentencing court find him indigent, these figures could change.
Marshall’s path to trial is not without its challenges. He was remanded into the custody of the U.S. Marshals Service as he awaited his day in court. The Bureau of Indian Affairs, Standing Rock Agency, has been tasked with investigating this case, while Assistant U.S. Attorney Troy R. Morley is spearheading the prosecution.
As Marshall’s fate hangs in the balance, one thing remains certain: the justice system stands ready to mete out its harshest penalties for those who dare to prey upon the vulnerable. A trial date has yet to be set, but Marshall’s name and the charge of Aggravated Sexual Abuse are etched into the annals of federal crime in South Dakota.
