Anthony Dale Helton, a 50-year-old man from High View, West Virginia, is facing federal charges for failing to register as a sex offender after crossing state lines—a violation that exposes him to up to 10 years behind bars and a $250,000 fine. The indictment, returned this week by a federal grand jury in Martinsburg, marks the latest fallout from Helton’s 2017 movements across state lines without complying with the law.
Helton, previously convicted of a sex offense in South Carolina, allegedly traveled into Hampshire County, West Virginia, in November and December 2017 without updating his registration under the federal Sex Offender Registration and Notification Act (SORNA). That failure forms the basis of a single count of “Failure to Register,” a felony punishable by a decade in prison and steep financial penalties.
In a separate but similarly charged case, Robert W. Tucker, Jr., 43, of Star City, West Virginia, was also indicted on one count of “Failure to Update Sex Offender Registration.” Tucker reportedly traveled from Monongalia County, West Virginia, to South Carolina and North Carolina in August 2016 and September 2017 without making the legally required updates to his status on the national registry.
Both men now face the full weight of federal prosecution. Each count carries a maximum sentence of 10 years in federal prison and a fine of up to $250,000. Under the Federal Sentencing Guidelines, the final outcome for either defendant will hinge on the severity of the violation and any prior criminal history the court deems relevant at sentencing.
The Helton case is being prosecuted by Assistant U.S. Attorney Lara Omps-Botteicher, while Assistant U.S. Attorney Sara E. Wagner is handling the prosecution against Tucker. Both cases were investigated by the United States Marshals Service—a clear signal that federal authorities are actively tracking compliance among registered sex offenders across state lines.
An indictment is not a conviction. Anthony Dale Helton and Robert W. Tucker, Jr. are presumed innocent unless proven guilty in a court of law. The cases will proceed under federal jurisdiction in the Northern District of West Virginia, where pretrial hearings and trial dates are expected to be scheduled in the coming weeks.
