Melecio Lopez-Hernandez Pleads Guilty to Assaulting Border Patrol Agent

A 39-year-old Mexican national admitted in federal court to attacking a U.S. Border Patrol agent with a flashlight during a violent arrest south of Freer, Texas. Melecio Lopez-Hernandez pled guilty to assault on a federal officer, a charge carrying up to 20 years in prison and a $250,000 fine.

The assault unfolded on February 7, 2019, when a Border Patrol agent spotted Lopez-Hernandez walking through dense brush in a remote stretch of South Texas. As the agent moved to detain him, Lopez-Hernandez resisted, initiating a physical struggle that quickly turned dangerous.

During the scuffle, Lopez-Hernandez ripped a flashlight from the agent’s outer vest and brandished it as a weapon. Witnesses say he issued verbal threats before swinging the flashlight and striking the agent directly in the head. The officer suffered injuries from the blow and required medical attention.

Authorities took Lopez-Hernandez into custody at the scene. He has remained behind bars since the attack and will stay in federal detention until sentencing. U.S. District Judge Marina Garcia Marmolejo has scheduled the hearing for September 17, 2019.

The FBI and U.S. Border Patrol jointly led the investigation into the assault. Prosecutors, led by Assistant U.S. Attorney Jennifer Day, secured the guilty plea in federal court in Laredo, underscoring the severity of attacks on federal law enforcement.

Lopez-Hernandez, an undocumented alien, now faces the full weight of federal sentencing guidelines. The case adds to a growing list of violent confrontations along the southern border, where agents increasingly report dangerous resistance during routine interdictions.
